1. Who we are

2. Scope

These terms apply to all orders placed through this website. If you buy as a consumer, the mandatory consumer protection rules of your country of residence also apply and are not limited by these terms.

3. Products

All designs are original artworks by Croatian artist Ivana Barišić Tomšić. Every item is made to order: fine art prints by our print partner WhiteWall (Germany), clothing and accessories by our print-on-demand production partner. Colours on screen may differ slightly from the finished product. Images showing an artwork in a room are illustrations; exact sizes are stated on each product page.

4. Placing an order

Product listings on this website are an invitation to order. By completing checkout you make a binding offer to buy. The contract is concluded when we confirm your order by email. We may decline an order, for example in case of an obvious pricing error; any payment already made will then be refunded in full.

5. Prices and payment

All prices are in euros (EUR). Kaya Bee is not registered for VAT, so no VAT is charged (Article 90(1) of the Croatian VAT Act). Shipping costs are shown at checkout before you pay. Payment is made at checkout using one of the payment methods offered there.

6. Delivery

We deliver to the countries offered at checkout. Production and delivery times, and information on customs, are set out in our Shipping Policy.

7. Withdrawal, returns and defects

Your 14-day right of withdrawal, the replacement of damaged or defective items and cancellations are described in our Refund Policy. Your statutory rights for defective goods remain unaffected.

8. Copyright

All artworks, images and texts on this website are protected by copyright. Buying a print or a garment does not give you the right to reproduce the artwork. Content from this website may not be copied or used commercially without our written permission.

9. Liability

We are liable in accordance with applicable law. We are not liable for indirect damage or for temporary unavailability of the website, except where the law does not allow such exclusion, in particular in cases of intent, gross negligence or injury to life, body or health.

10. Personal data

How we handle your personal data is described in our Privacy Policy.

11. Applicable law and disputes

Croatian law applies. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live. If something goes wrong, please contact us first – we will look for a fair solution. Consumers may also turn to an out-of-court consumer dispute resolution body or the competent court.

12. Changes to these terms

We may update these terms from time to time. The version valid at the time of your order applies to that order.
